Terms of Service

1. Who we are

LUUT ("we," "us," "LUUT") operates a platform at luut.gg where buyers post bounties for Pokémon trading cards and sellers respond with offers. By creating an account or using the service, you agree to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use LUUT. By signing up, you represent and warrant that you meet this requirement and that the information you provide is accurate. At launch, LUUT serves United States individuals and United States shipping addresses only. Transactions to or from addresses outside the United States are not supported.

3. Your account

  • You're responsible for activity that happens under your account, including offers, listings, and payment instruments you link.
  • Keep your credentials secure. Notify us immediately at support@luut.gg if you suspect unauthorized access.
  • One account per person. Creating multiple accounts to manipulate ratings, reviews, waitlist position, or affiliate counts is prohibited and will result in suspension or ban.

4. How LUUT works

Buyers post bounties describing a Pokémon card they want at a stated price. Sellers respond with offers. If a buyer accepts an offer, LUUT facilitates payment through Stripe and shipping through Shippo. Funds are held by LUUT (acting as an escrow agent) until delivery is confirmed and the dispute window has elapsed.

5. Fees

  • Buyers pay the agreed item price plus shipping. Shipping cost stays with LUUT (LUUT purchases the label).
  • Sellers receive the item price minus a platform fee. The platform fee is disclosed at offer-acceptance time and applies only to the item amount.
  • Stripe processing fees pass through to the seller on payout.

6. Prohibited conduct

  • Listing counterfeit, stolen, or misrepresented cards. Where a seller ships a counterfeit, LUUT may reverse the sale and recover the refunded amount and associated fees from the seller's balance or future payouts, and may suspend the account until the amount is recovered.
  • Shilling, fake reviews, sockpuppet accounts, and ratings manipulation.
  • Circumventing LUUT to settle transactions off-platform after match.
  • Harassment, threats, or abusive conduct toward other users or staff.
  • Scraping, automated registration, or bot-driven affiliate farming.

7. Refunds, disputes, cancellations

Refunds are not guaranteed. A buyer may raise an issue only within a 72-hour window after delivery, and only where a card is not as described, is counterfeit, or was not received. Raising an issue opens a resolution process arbitrated by LUUT: both parties provide evidence, and LUUT makes the final decision (a full refund, a partial refund, or release of funds to the seller). This process is internal to LUUT and is not a payment-card chargeback.

For a card that is not as described, a return is the default step before a refund is released. The seller decides whether they want the card back and may waive the return. Where a return is required, the seller covers return shipping, LUUT generates the label, and the seller has 72 hours from delivery of the returned card to confirm its condition before the refund is released. A card confirmed to be counterfeit is not returned to the seller; the buyer is made whole, the refund and associated fees may be recouped from the seller, and the buyer may be required to destroy or surrender the counterfeit. 8. Pre-launch & waitlist

During the pre-launch period, your account is on a waitlist. We assign your position automatically and may move it based on referral activity. Waitlist position is not a guarantee of access or any service. We may change, pause, or end the waitlist at any time without notice.

9. Intellectual property

Pokémon, Pokémon character names, and related trademarks are property of The Pokémon Company, Nintendo, Game Freak, and Creatures. LUUT is not affiliated with, endorsed by, or sponsored by any of them. The LUUT name, logo, and original site content are owned by LUUT and may not be copied without written permission.

10. Termination

We may suspend or terminate your account at our discretion for breach of these Terms, for fraud or harm to other users, or as required by law. You may delete your account at any time by emailing support@luut.gg; some data may be retained for legal, tax, and fraud-prevention reasons.

11. Disclaimers

The service is provided "as is" without warranties of any kind. We do not guarantee that listings are accurate, that sellers will ship, or that any specific outcome will result from your use of LUUT.

12. Limitation of liability

To the maximum extent permitted by law, LUUT's aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the total fees you paid LUUT in the 12 months before the claim or (b) US$100. We are not liable for indirect, incidental, consequential, or punitive damages.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. You and LUUT submit to the exclusive jurisdiction of state and federal courts located in Delaware for any dispute not otherwise subject to arbitration.

14. Changes

We may update these Terms. We'll notify you by email and post the updated version with a new effective date. Continued use after changes take effect means you accept the updated Terms.
